1. ACCEPTANCE OF TERMS

Piggy Bank Coupons, PiggyBankCoupons, PiggyBankCoupons.com (hereinafter referred to as “PiggyBankCoupons”, “PiggyBankCoupons.com“, “we”, “us”, or “our”), operated by DigiMktg Co. LLC, a New Mexico limited liability company with its principal place of business in Albuquerque, New Mexico, provides a digital coupon marketplace and cashback rewards program (the “Services”) which includes and is accessible via the website published at www.PiggyBankCoupons.com, our browser extension, and our mobile applications (collectively, the “Platform”).

By using the Services, you agree to comply with and be legally bound by these Terms of Service (“Terms”), whether or not you become a registered user. These Terms govern your access to and use of the Services and constitute a binding legal agreement between you and PiggyBankCoupons.

IF YOU DO NOT AGREE TO THESE TERMS, PLEASE DO NOT USE THE SERVICES.

These Terms incorporate by reference our Privacy Policy, which can be found at PiggyBankCoupons.com/privacy-policy 

Unauthorized access, distribution, reproduction, copying, retransmission, publication, sale, exploitation (commercial or otherwise), or any other form of transfer of any portion of the Platform or Services is expressly prohibited.

2. INTRODUCTION AND DEFINITIONS

2.1 Services Overview

PiggyBankCoupons offers discount coupons and cashback rewards on purchases from third-party merchants (“Merchants”). These offers are set by Merchants and may expire after a specified period. We recommend checking our Platform regularly for the best deals.

2.2 Definitions

  • “Account” means your registered user account with PiggyBankCoupons
  • “Cashback” means the rewards you earn on eligible purchases through our Platform
  • “Login” means registered access to certain elements of the Platform
  • “User” or “you” means any person who visits or uses the Platform
  • “Merchant” means third-party retailers and businesses whose coupons or cashback offers appear on our Platform
  • “Extension” means our browser extension software
  • “App” means our mobile application available on Google Play Store or other app stores

3. REGISTRATION AND ACCOUNTS

3.1 Account Creation

To utilize certain portions of the Services, including the cashback program, you must complete a registration process and establish an Account. You represent and warrant that:

  • You are at least 18 years of age
  • All information provided is current, accurate, and complete
  • You will maintain the accuracy and completeness of this information on a prompt, timely basis
  • You have the legal capacity to enter into a binding contract

3.2 Password and Security

You are solely responsible for:

  • Maintaining the confidentiality and security of your password(s) and Account(s)
  • All actions and postings made from your Account(s)
  • Notifying PiggyBankCoupons immediately of any unauthorized use of your Account(s)

Accounts are non-transferable. Sharing accounts is strictly prohibited and may result in immediate termination.

3.3 Account Inactivity and Closure

Inactive Accounts:

  • If you do not log in to your Account for 12 consecutive months, we reserve the right to close your Account
  • Accounts closed due to inactivity will forfeit any cashback balance under the minimum payout amount
  • We will send email notifications at 10 months and 11 months of inactivity before closure
  • You can prevent closure by logging in before the 12-month period expires

Voluntary Account Closure:

  • You may request Account closure at any time by contacting us at Privacy@DigiMktgco.com
  • Upon voluntary closure:
    • Cashback balances of $5.00 or more will be paid out within 30 days
    • Cashback balances under $5.00 will be forfeited
    • Transaction records will be retained for 7 years for tax and legal compliance
    • All other personal data will be deleted within 30 days

Account Termination by PiggyBankCoupons:

  • We reserve the right to suspend or terminate your Account at any time for violation of these Terms
  • Terminated accounts for fraud or Terms violations will forfeit all cashback, regardless of balance

4. CASHBACK PROGRAM

4.1 Earning Cashback

You earn cashback by:

  • Making purchases at participating Merchants through our links
  • Shopping with our browser Extension or mobile App active
  • Following specific offer requirements (minimum purchase amounts, excluded items, etc.)

4.2 Cashback Eligibility

Eligible Purchases:

  • Must be made through PiggyBankCoupons links or with our Extension/App active
  • Must be confirmed by the Merchant and affiliate network
  • Must comply with Merchant terms and conditions

Ineligible Purchases:

  • Returns, cancellations, or exchanges
  • Purchases using unauthorized coupons or exploits
  • Fraudulent transactions
  • Gift card purchases (unless explicitly stated as eligible)
  • Purchases made while using ad blockers or VPNs that interfere with tracking

4.3 Cashback Calculation and Tracking

Cashback amounts are determined by:

  • Merchant-specific rates (which may change without notice)
  • Purchase confirmation from affiliate networks
  • Compliance with offer terms

Pending Period: Cashback typically remains “pending” for 30-90 days while Merchants confirm purchases and process returns.

4.4 Payouts

Minimum Payout Amount: $5.00

Payment Method: PayPal only

  • You must provide a valid PayPal email address
  • We do not offer alternative payment methods at this time

Processing Time:

  • Payout requests are processed within 5-10 business days
  • PayPal may take additional time to credit your account

Payout Requests:

  • You may request a payout once your confirmed cashback balance reaches $5.00
  • Submit payout requests through your Account dashboard

Identity Verification:

  • We reserve the right to request government-issued photo identification to verify your identity before processing payouts
  • Verification may be required for fraud prevention, security, or legal compliance
  • Failure to provide requested verification may result in payout delays or denial

4.5 Tax Reporting

IRS Reporting Requirements:

  • If your annual cashback earnings reach or exceed $600.00, you will be required to provide your:
    • Full legal name
    • Mailing address
    • Social Security Number (SSN) or Employer Identification Number (EIN)
  • We will issue IRS Form 1099-MISC or 1099-NEC by January 31st of the following year
  • We are legally required to report these earnings to the IRS
  • Failure to provide tax information for $600+ earnings will result in payout suspension

Tax Responsibility:

  • You are solely responsible for reporting and paying all applicable taxes on your cashback earnings
  • Consult a tax professional for guidance

4.6 Fraud Prevention

We actively monitor for fraudulent activity, including but not limited to:

  • Multiple accounts from the same individual
  • Use of unauthorized coupons, bots, or exploits
  • Returns or chargebacks after receiving cashback
  • Suspicious purchase patterns or gaming the system
  • Use of stolen credit cards or fraudulent payment methods

Consequences of Fraud:

  • Immediate Account termination
  • Forfeiture of all cashback (pending and confirmed)
  • Legal action and reporting to law enforcement
  • Permanent ban from PiggyBankCoupons services

4.7 Cashback Modifications

We reserve the right to:

  • Modify cashback rates at any time without prior notice
  • Revoke cashback for transactions that violate Terms or Merchant policies
  • Correct cashback amounts due to errors or miscalculations
  • Remove cashback from accounts found to be in violation of these Terms

5. WEBSITE GIVEAWAY PROGRAM

5.1 Program Overview

PiggyBankCoupons may periodically offer website giveaways where selected users receive a pre-built WordPress website at no cost.

5.2 Giveaway Terms

What You Receive:

  • WordPress website files only
  • Pre-configured theme and plugins
  • Basic setup and configuration

What Is NOT Included:

  • Domain name registration
  • Web hosting services
  • Ongoing maintenance or support
  • Custom development or modifications

5.3 Hosting Requirements

To activate your giveaway website, you must:

Option 1: Use Recommended Hosting Partner

  • Purchase hosting through one of our recommended hosting partners
  • We will install and configure your website at no additional charge
  • Hosting must be purchased within 30 days of winning

Option 2: Pay Installation Fee

  • If you choose your own hosting provider (not on our recommended list)
  • Pay a $65 installation and setup fee
  • Fee is non-refundable once installation begins

5.4 Customization and Add-Ons

Standard Giveaway Website:

  • Includes only the pre-configured features and design
  • No customization or modifications included

Additional Customizations:

  • Custom design work, additional features, or modifications beyond the standard giveaway are available for an additional fee
  • All fees must be paid upfront before work begins
  • You are responsible for all costs associated with premium themes, plugins, or third-party services

5.5 Program Modifications and Termination

We reserve the right to:

  • Modify or discontinue the website giveaway program at any time without notice
  • Change eligibility requirements
  • Limit the number of giveaways per period
  • Reject or cancel any giveaway award at our sole discretion

Giveaway winners forfeit their prize if:

  • They fail to claim within 30 days of notification
  • They do not complete hosting setup within 60 days
  • They violate these Terms or engage in fraudulent activity

5.6 Ownership and License

  • You receive a non-exclusive license to use the provided WordPress files
  • We retain all rights to our proprietary themes, templates, and configurations
  • You may not resell, redistribute, or commercialize the website files

6. BROWSER EXTENSION AND MOBILE APP

6.1 License Grant

We grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use our browser Extension and mobile App solely for your personal, non-commercial use.

6.2 Extension/App Functionality

Our Extension and App:

  • Automatically find and apply coupon codes at checkout
  • Track eligible purchases for cashback rewards
  • Display relevant deals and offers while you shop
  • Require certain permissions to function (see Privacy Policy for details)

6.3 Restrictions

You may not:

  • Modify, reverse engineer, or decompile the Extension or App
  • Use the Extension or App for commercial purposes
  • Circumvent any security features or tracking mechanisms
  • Share or redistribute the Extension or App files

6.4 Updates and Modifications

  • We may update the Extension or App at any time to add features, fix bugs, or improve security
  • Updates may be automatic or require manual installation
  • Continued use after updates constitutes acceptance of the updated version

6.5 Uninstallation

  • You may uninstall the Extension or App at any time
  • Your Account and cashback balance remain active after uninstallation
  • You can continue using the website to access your Account

6.6 Google Play Store and App Stores

By downloading our App from Google Play Store or other app stores, you also agree to:

  • The applicable app store’s terms of service
  • The app store’s payment and refund policies (if applicable)
  • The app store’s privacy policies

We are not responsible for any app store policies or practices.

7. PROMOTIONS AND GIVEAWAYS

7.1 General Terms

We may offer promotions, contests, sweepstakes, or special cashback bonuses from time to time.

7.2 Modification and Termination

We reserve the right to:

  • Modify, suspend, or terminate any promotion or giveaway at any time without notice
  • Change eligibility requirements, rules, or rewards
  • Disqualify participants who violate promotion terms or these Terms of Service
  • Substitute prizes or rewards of equal or greater value

7.3 No Obligation

We are under no obligation to:

  • Offer any specific promotion or giveaway
  • Continue any promotion for any specified duration
  • Provide advance notice of changes or terminations

7.4 Additional Rules

Specific promotions may have additional terms and conditions, which will be provided at the time of the promotion. Those terms are incorporated into these Terms by reference.

8. PRIVACY

PiggyBankCoupons respects user privacy. Our Privacy Policy, available at [Privacy Policy URL], is expressly incorporated into these Terms by reference.

By using the Services, you consent to our collection, use, and sharing of information as described in the Privacy Policy.

9. USER-GENERATED CONTENT

9.1 Content Responsibility

PiggyBankCoupons does not pre-screen or regularly review all user-contributed content. However, we reserve the absolute right (though not the obligation) to remove, without notice, any content posted to the Platform.

9.2 Representations and Warranties

By posting any content, you represent and warrant that:

  • You have all right, title, and interest to such content, including any necessary consents, authorizations, releases, or licenses from third parties
  • The content is in the public domain, or your use constitutes fair use
  • Posting such content does not violate or infringe any patent, copyright, trademark, trade secret, right of privacy, right of publicity, moral rights, or other intellectual property right
  • The content does not breach any agreement with any other person or entity

9.3 Prohibited Content

You agree not to post content that:

  • Contains adult content, pornography, explicit sexual images, or nudity
  • Promotes hate, abuse, violence, or destructive actions
  • Promotes illegal activities
  • Is primarily political, religious, psychic, or metaphysical in nature
  • Promotes pirated software or intellectual property theft
  • Is intended for phishing or spreading malware
  • Is disparaging of any person or entity
  • Violates any law or regulation
  • Is or could be considered inappropriate, unsuitable, or offensive (as determined by us in our sole discretion)

9.4 License to PiggyBankCoupons

By posting or contributing content to the Services, or by providing any feedback, suggestions, ideas, or other submissions, you grant PiggyBankCoupons:

  • A non-exclusive, royalty-free, perpetual, irrevocable, and worldwide license to use your content
  • The right to copy, distribute, transmit, publicly display, publicly perform, reproduce, edit, translate, and reformat your content
  • The right to incorporate your content into collective works
  • The right to sublicense any or all of these rights to others

You waive all moral rights in favor of PiggyBankCoupons. This means we may use any ideas, feedback, or suggestions you submit in any manner we choose, without notice or compensation.

10. ACCEPTABLE USE

10.1 License Grant

PiggyBankCoupons grants you a limited, non-exclusive, non-transferable license to access and use the Services solely for your personal use in the manner permitted by these Terms.

10.2 Prohibited Activities

You shall not:

Account Misuse:

  • Use the Services in violation of any agreement, including employment agreements
  • Impersonate any person or misrepresent your identity or affiliation
  • Share your password or login credentials
  • Create multiple accounts or fake accounts
  • Access accounts you are not authorized to access

Technical Interference:

  • Violate or attempt to violate any security features
  • Use automated software, bots, scripts, or crawlers to access the Platform
  • Introduce viruses, malware, Trojan horses, or harmful code
  • Interfere with other users’ use of the Services through overloading, flooding, spamming, or crashing
  • Tamper with the operation, functionality, or security of the Services
  • Attempt to probe, scan, or test vulnerabilities of the Services or any associated systems
  • Reverse engineer, decompile, or disassemble any part of the Services

Content Misuse:

  • Harvest or collect email addresses or contact information of other users
  • Engage in framing, mirroring, or simulating the appearance of the Services
  • Deep-link to the Services without our express written permission
  • Hyperlink to the Services from other websites without our ongoing consent

Commercial Misuse:

  • Act illegally or maliciously against our business interests or reputation
  • Use the Services to advertise, solicit, or compete with PiggyBankCoupons
  • Resell or repurpose access to the Services or purchases made through the Services
  • Solicit users or Merchants to use competing services
  • Aggregate coupons or deals for competing platforms

Violations may result in civil or criminal liability. You are responsible for installing anti-virus software and protections against malicious code.

11. ACCURACY AND DISCLAIMERS

11.1 Offer Accuracy

PiggyBankCoupons makes no representation or warranty as to:

  • The accuracy or fitness for use of any offers, coupons, rebates, or discounts
  • Whether any Merchant will honor any offers posted via the Services
  • The availability, pricing, or fitness for use of any Merchant products or services

11.2 Third-Party Responsibility

  • We are not responsible for providing value for any offers, coupons, or discounts
  • We are not responsible for changes to Merchant information, pricing, or availability
  • We do not review all third-party websites linked to or from the Services

11.3 Service Availability

We do not warrant that:

  • The Services will be uninterrupted or error-free
  • Defects will be corrected
  • The Services or servers are free of viruses or bugs
  • The Services will meet your specific requirements

12. DISCLAIMER OF WARRANTIES

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.

TO THE FULL EXTENT PERMISSIBLE BY LAW, PIGGYBANCKCOUPONS DISCLAIMS ALL WARRANTIES, INCLUDING:

  • Implied warranties of merchantability
  • Fitness for a particular purpose
  • Non-infringement
  • Title
  • Warranties arising from course of dealing or usage of trade

WE DO NOT WARRANT THAT:

  • The Services will meet your requirements
  • The Services will be secure, timely, uninterrupted, or error-free
  • The results obtained from using the Services will be accurate or reliable
  • The quality of any products, services, information, or other material obtained through the Services will meet your expectations
  • Any errors in the Services will be corrected

All pictures shown or used on PiggyBankCoupons are for illustration purposes only.

13. LIMITATION OF LIABILITY

13.1 No Liability for Damages

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PIGGYBANCKCOUPONS SHALL NOT BE LIABLE FOR ANY DAMAGES OF ANY KIND ARISING FROM THE USE OF THE SERVICES, INCLUDING BUT NOT LIMITED TO:

  • Direct, indirect, incidental, punitive, special, or consequential damages
  • Loss of profits, revenue, data, or business opportunities
  • Personal injury or property damage
  • Damages arising from Merchant conduct or failure to honor offers
  • Damages arising from third-party content or conduct

This limitation applies regardless of the legal theory (contract, tort, strict liability, etc.) and even if PiggyBankCoupons was advised of the possibility of such damages.

13.2 Merchant Liability

IN NO EVENT SHALL PIGGYBANCKCOUPONS BE LIABLE FOR ANY DAMAGES ARISING OUT OF OR CONNECTED WITH:

  • A Merchant’s offers, products, or services
  • A Merchant’s failure to honor coupons or cashback
  • A Merchant’s violation of applicable laws
  • A Merchant’s conduct or speech, online or offline

13.3 Maximum Liability

If, notwithstanding the foregoing, PiggyBankCoupons is found liable for any damages, our total liability shall not exceed the greater of:

  • The amount of cashback you earned in the 12 months preceding the claim, or
  • $100.00

13.4 Release

YOU ARE SOLELY RESPONSIBLE FOR YOUR INTERACTIONS WITH MERCHANTS AND OTHER USERS.

You hereby release PiggyBankCoupons from any and all claims or liability related to:

  • Any product or service of a Merchant
  • Any action or inaction by a Merchant
  • A Merchant’s failure to comply with applicable laws
  • Any conduct or speech of any other user, whether online or offline

14. INDEMNIFICATION

You agree to indemnify, defend, and hold harmless PiggyBankCoupons, DigiMktg Co. LLC, and our officers, directors, employees, agents, affiliates, and licensors from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses (including reasonable attorney’s fees) arising from:

  • Your use of the Services
  • Your violation of these Terms
  • Your violation of any third-party rights, including intellectual property rights or privacy rights
  • Your user-generated content
  • Your fraudulent or illegal activities
  • Any claim that your content caused damage to a third party

This indemnification obligation survives termination of these Terms and your use of the Services.

15. INTELLECTUAL PROPERTY

15.1 Ownership

All right, title, and interest in the Services, including:

  • Technology, software, and trade secrets
  • Copyrights, patents, trademarks, and trade dress
  • Derivative works and custom developments
  • All proprietary rights

Belong solely and exclusively to PiggyBankCoupons or its licensors.

You acknowledge that the Services constitute valuable trade secrets and confidential information.

15.2 Works and Content

All content and materials included in the Services (the “Works”), including:

  • Text, graphics, logos, icons, images, audio, video
  • Software, code, forms, data, databases
  • Typefaces, graphics, music, sounds

Are the property of PiggyBankCoupons, its licensors, or applicable third parties (such as Merchants).

The Works are protected by copyright, trademark, trade secret, and other intellectual property laws.

15.3 Restrictions

You may not:

  • Modify, remove, delete, augment, add to, publish, transmit, adapt, translate, participate in the transfer or sale of, or create derivative works from any of the Works
  • Reproduce, copy, distribute, display, perform, or use the Works except as expressly permitted
  • Use the Works for any commercial purpose
  • Remove or alter any copyright, trademark, or proprietary notices

Unauthorized use of the Works may cause irreparable harm to PiggyBankCoupons and may result in injunctive relief and monetary damages.

15.4 Trademarks

“PiggyBankCoupons,” “Piggy Bank Coupons,” our logo, and all related marks (the “Marks”) are trademarks of PiggyBankCoupons, registered under the Trademark Act.

You may not:

  • Display or use our Marks without prior written permission
  • Use our Marks in a manner that creates confusion or implies endorsement
  • Register domain names, social media handles, or business names containing our Marks

Third-party trademarks are the property of their respective owners. Presence of third-party trademarks does not imply any relationship or endorsement.

Infringement of our intellectual property rights will result in serious legal action.

16. LINKING

16.1 Third-Party Links

The Services may contain links to third-party websites. We are not responsible for:

  • The content of third-party websites
  • The privacy practices of third-party websites
  • Any harm or damages arising from third-party websites

Linking to or from the Services does not imply endorsement, affiliation, or sponsorship.

16.2 Your Responsibility

You agree to:

  • Carefully read the terms of use and privacy policies of third-party websites
  • Understand that third parties may collect and use your information differently
  • Release PiggyBankCoupons from any liability related to third-party websites

17. CHATBOT AND AI FEATURES

17.1 AI Chatbot

We may offer an AI-powered chatbot to assist users with:

  • Finding coupons and deals
  • Answering common questions
  • Providing customer support

17.2 Chatbot Limitations

The chatbot:

  • May not always provide accurate or complete information
  • Should not be relied upon for critical decisions
  • Is not a substitute for human customer support
  • May collect and analyze your messages to improve performance

We are not liable for:

  • Errors or omissions in chatbot responses
  • Damages arising from reliance on chatbot information
  • Chatbot malfunctions or unavailability

17.3 Data Collection

Messages sent to the chatbot may be:

  • Analyzed to improve AI performance
  • Reviewed by human staff for quality assurance
  • Used to train machine learning models

Do not share sensitive personal information (passwords, full credit card numbers, etc.) with the chatbot.

18. ARBITRATION AND DISPUTE RESOLUTION

18.1 Agreement to Arbitrate

YOU AND PIGGYBANCKCOUPONS AGREE THAT ANY DISPUTE, CLAIM, OR CONTROVERSY ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICES SHALL BE RESOLVED THROUGH BINDING ARBITRATION, RATHER THAN IN COURT, EXCEPT AS PROVIDED BELOW.

By agreeing to arbitration, you waive your right to:

  • Have disputes heard by a judge or jury
  • Participate in class actions or class arbitrations

18.2 Arbitration Procedures

Arbitration shall be conducted by:

  • American Arbitration Association (AAA) under its Consumer Arbitration Rules
  • Or JAMS if both parties agree

Location: Arbitration will be conducted in Albuquerque, New Mexico, unless both parties agree to an alternative location or to conduct arbitration by telephone, video conference, or written submissions.

Costs: Each party shall bear their own costs and fees. The arbitrator may award costs and fees to the prevailing party.

Rules: The arbitrator shall apply New Mexico law and these Terms.

Discovery: Discovery shall be limited as determined by the arbitrator.

Award: The arbitrator’s decision is final and binding, and may be entered as a judgment in any court of competent jurisdiction.

18.3 Exceptions to Arbitration

The following disputes are NOT subject to arbitration:

  • Claims brought in small claims court (if within the court’s jurisdiction)
  • Claims seeking injunctive or equitable relief for intellectual property infringement
  • Claims related to fraud, criminal activity, or violations of the Computer Fraud and Abuse Act

18.4 Class Action Waiver

YOU AND PIGGYBANCKCOUPONS AGREE THAT DISPUTES MUST BE BROUGHT ON AN INDIVIDUAL BASIS ONLY, AND NOT AS PART OF A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION.

There shall be no right or authority for:

  • Any dispute to be arbitrated on a class-action basis
  • Any dispute to be arbitrated in a representative capacity on behalf of others
  • Joinder or consolidation of claims

If this class action waiver is found unenforceable, the entire arbitration agreement shall be null and void.

18.5 Opt-Out Right

You have the right to opt out of this arbitration agreement within 30 days of first accepting these Terms by:

  • Including your name, address, email, and a statement that you wish to opt out of arbitration

If you opt out:

  • You will not be bound by the arbitration agreement
  • All other terms remain in effect
  • Disputes will be resolved in court (subject to Section 19)

19. GOVERNING LAW AND JURISDICTION

19.1 Governing Law

These Terms and your use of the Services shall be governed by and construed in accordance with the laws of the State of New Mexico and the United States of America, without regard to conflict of law principles.

19.2 Jurisdiction and Venue

If arbitration does not apply (due to opt-out or exceptions), you agree that:

  • Any legal action or proceeding shall be brought exclusively in the state or federal courts located in Albuquerque, Bernalillo County, New Mexico
  • You consent to the personal jurisdiction of such courts
  • You waive any objection to venue in such courts

19.3 Attorney’s Fees

If any dispute proceeds to court or arbitration, the prevailing party shall be entitled to recover:

  • Reasonable attorney’s fees and costs
  • Court costs and filing fees
  • Arbitration costs and fees
  • Expert witness fees
  • All other litigation expenses

You agree that if you bring a claim against PiggyBankCoupons and do not prevail, you will be responsible for our legal costs and fees.

19.4 Waiver of Jury Trial
